All artworks from 35 Corks Art Studio (Bradley Manker) are created and protected under Title 17 of the United States Code and the Copyright Act of 1976 and all subsequent amendments thereof. Further protections are provided by the Digital Millennium Copyright Act (“DMCA”) and/or the Lanham (Trademark) act 1946.

Some artwork contained within this store is registered with the United States Copyright Office (Registration No. VA-0002199226). Any items not registered are also protected by the above-mentioned acts. All rights are expressly reserved over registered and unregistered copyrights.

These TERMS OF USE (“TOU”) apply to all products on this website or elsewhere. 35 Corks Art Studio reserves the right to change them at any point with or without notice. By purchasing any items contained herein, you hereby consent to any and all revisions of these TOUs whether you receive notice or not.

As with all artwork purchased in the 35 Corks Art Studio store, you are purchasing a limited license to use the artwork. Nothing contained herein should be construed in any other manner. All artwork and relevant copyrights are owned exclusively by 35 Corks Art Studio or licensed for use by others.

By purchasing any items, you are granted a limited license of use and you agree to abide by the following terms of use, and any and all updates or revisions thereof.

Personal Use Licenses

Personal use licenses are sold to individuals and constitute SINGLE USER license agreements. These products may not be shared, distributed, recreated, altered, amended or sold by you or anyone else connected to you either directly or indirectly for any reason or for any purpose whatsoever except as provided herein. Purchaser may not, under any circumstances, use a personal license for commercial activities. Personal use licensed products may not be used by businesses, non-profits, not-for- profits, or any other organizations. Once purchased, the personal use licensed products may be used for unlimited personal use.

Free items generally, but not always, fall under the personal use licensing rules and may not be added to any products that are sold online.

Commercial Use Licenses

When using 35 Corks Art Studio clip art to create products for sale, the following items are expressly forbidden:

• word wall cards, clip cards, pocket chart cards

• flashcards and similar products

• posters

• banners

• coloring sheets

• matching games

• some printables, such as finger puppets

Commercial use licenses are purchased by those who wish to use 35 Corks Art Studio artworks on products to create their own educational materials to sell online. 35 Corks Art Studio does not receive any continuing royalties on derivative artwork created by purchaser. 35 Corks Art Studio products may be used commercially under the following rules:

1. You must give credit and acknowledgment to 35 Corks Art Studio and a link to my website in any final product. The link must be a clickable hyperlink when possible.

2. You may not purchase digital graphic files and repackage or resell them as your own.

3. Files must be flattened in JPEG or PDF file formats so that they are not easily extracted by others. Files not flattened are easily stolen and you acknowledge that this license conveys certain obligations on purchaser regarding flattening of purchased items.

4. Your final product may not be a showcase of the artwork but must have your own original and unique content contained therein. 35 Corks Art Studio artworks may only enhance your products and not be the main focus of your products. At least 75% of your own educational content added to the product is a general baseline. Word walls, flashcards, banners, printable posters, coloring sheets, matching games and the like are not authorized for any reason whatsoever.

5. 35 Corks Art Studio artwork may never be used for physical products on sites such as Zazzle, Etsy, RedBubble, et cetera. This is not, and should not be construed as, an exhaustive list of websites where 35 Corks Art Studio clip art is prohibited from being used. 35 Corks Art Studio reserves the right to add any website or store, at will, with or without notice.

6. 35 Corks Art Studio illustrations may not be used with “print-on-demand” sites, such as Printful or Printiful.

7. 35 Corks Art Studio artwork may not be used to create and sell printed stationery, cards, brochures, flyers, business cards, games, jewelry, clothing, accessories, or home decoration without specific written consent from 35 Corks Art Studio.

8. 35 Corks Art Studio artwork is not to be used in a manner that is unlawful, harmful, abusive, racially or ethnically offensive, defamatory, deceptive, infringing, invasive or personal property or publicity rights, harassing, or is otherwise objectionable. 35 Corks Art Studio is the sole arbiter of what can be described, as such, and all decisions thereof are final. Purchaser acknowledges and obligation to immediately cease use of purchased artwork upon notice by 35 Corks Art Studio.

9. If a purchaser has previously purchased a personal use license and later decides to sell these items online, purchaser must purchase a new commercial license. No refunds will be given for previously purchases personal use licenses if purchaser chooses to purchase a commercial license at a later date.

10. Purchaser agrees to indemnify and hold harmless 35 Corks Art Studio against any and all claims caused by purchasers use which is negligent or willful, whether commercial or otherwise, or any reason. Purchase expressly waives any “downstream” claim, subrogation rights and any other rights. 35 Corks Art Studio reserves all rights to choose its own defense counsel at the expense of purchaser in the event of any claim against it caused by purchaser’s conduct.

11. 35 Corks Art Studio reserves the right to terminate purchaser’s commercial license for any reason at any time, with or without notice. Purchaser agrees that it will immediately cease all use whether commercial or otherwise upon discovery of termination. No refunds or credits will be given except as expressly authorized by 35 Corks Art Studio.

12. In the event of any violations of these Terms of Use, breaches or other sort of event, purchaser agrees to the choice of venue and choice of law in the State of Oregon, without conflict to its laws whether known or unknown. The appropriate venue for any such claim shall be in Multnomah County, Oregon. Purchaser agrees and expressly waives their rights to object to 35 Corks Art Studio’s choice of venue. 35 Corks Art Studio reserves the right to change the venue at any time before such claim is filed.

13. In the event of any breach by purchaser, purchaser agrees that any such violation or breach constitutes irreparable harm to 35 Corks Art Studio and agrees that 35 Corks Art Studio is entitled to and shall obtain a permanent injunction enjoining purchaser’s continued use.

14. Purchaser agrees that they are sophisticated to the extent required to understand and agree to these TOUs.

15. Some clip art pieces in this store may be listed in multiple sets. It is the responsibility of purchaser to read product descriptions, carefully, to ensure the correct product is purchased. Due to the digital nature of the reference artwork and/or products, no refunds will be granted for any reason.
